Terms Of Use

The basics.

• A gig is a service that’s offered.
• The price of a gig ranges from $5 to $500. Multiple gigs can be purchased.
• Registration on Gigsido is free and listing your gig on the site is free.
• Only registered members can buy or sell gigs.
• To order a gig, use the “Order” button. Members may not offer or accept payments for gigs outside of the site. Gigs offered on the Gigsido site should only be purchased within the site.
• Sellers should always complete all orders, they should not intentionally cancel orders.
• Once a gig has been ordered, both the buyer and seller will have access to the other's Skype (or other voice/video chat software user names) name.
• Once a gig has been ordered, the buyer and seller agree upon a time to perform the gig using Skype or other voice/video chat software.
• All rights to the work exchanged are granted to the buyers of gigs unless otherwise specified within the seller’s gig description.

Buyers. Ordering a gig

• Gigs are purchased using a credit card or PayPal or AlertPay in advance. Sellers are only paid after the gig has been delivered.
• On payment confirmation, your order will be created.
• Buyer’s identities are always kept anonymous. To protect your privacy, never request or offer your personal contact information to include email address, phone numbers or Skype names or other voice/video chat user names.
• Never offer or accept payment for gigs other than using gigsido-ordering process.
• If you get offered to pay via any other method report it to us immediately via this link. This is for your own privacy and protection.
• Avoid filing a dispute with or reversing a payment either via PayPal or your bank.
• If a problem arises, always try to resolve it with the seller. If you need further assistance please contact our support staff.

Sellers

• Buyers pay Gigsido in advance for gigs.
• The seller decides the price of their gig, which ranges from $5 to $500. When a gig is purchased and successfully delivered to the buyer, the seller's account gets credited with the amount less the 20% admin fee. Only completed gigs are credited to the seller.
• Once the seller has delivered a gig then the seller’s account is credited.
• Gigs are for a period of one hour or less as specified in the description. If more time is needed then multiple gigs should be purchased.
• If an order is cancelled, for whatever reason, then the buyer’s payment is returned to the buyer.
• Seller’s feedback and ratings are calculated by feedback from buyers and considering the amount of orders cancelled and late deliveries.

The ordering process

• When a buyer orders a gig, the seller will receive an email alerting them that there is a message within their Gigsido message inbox.
• Sellers are required to deliver the gig within the time frame specified under "expected delivery" when creating the gig. Being late on delivery may affect the sellers ratings. Failing to deliver the gig within the specified time frame permits the buyer to cancel the order.
• Both buyers and sellers have the right to cancel an order by mutual agreement. Agreeing mutually to cancel has no negative affect on either party.
• A seller can cancel the order at anytime, however this will have a negative effect on the sellers rating.

Keep out of trouble

• Member’s privacy protection is taken seriously and all users identities are kept anonymous. Providing or requesting any form of personal contact details is not permitted including email addresses, phone numbers, Skype user names or other voice/video chat software user names.
• Creating or sending any abusive, offensive, rude, illegal, improper, copyright protected, spam, or promotional materials is strictly prohibited. Disobeying this will get your member account deleted and permanently blocked.
• All communication prior to the purchase of a gig should be performed using the internal Gigsido messaging system to include the sending of files. Even after the purchase of a gig, it's recommended to continue to use the Gigsido messaging system for non voice/video chat.

Files exchanged and communication

• You are responsible for scanning all transferred files for viruses and any other malware or potentially malicious software. Gigsido will not be responsible for any damages which may occur due to the use of the site or files exchanged.
• Sellers must use the "Deliver Completed Work" tab located within the order page for delivering any other requested work and proof of completed work after the interactive gig has been delivered and completed. All sellers after the work is completed most go to the “Deliver Completed Work” tab within the Sellers\Mange sales orders tab. At the bottom of this screen there is the “Deliver Completed Work” tab. Once you add the info and click “Submit” this then completes the gig.
• After the gig is completed and delivered, the buyer has three days to respond. After this time, the order will be marked as complete.

Withdrawing revenues

• The withdraw of revenue earned requires a valid PayPal account. Ensure that your PayPal account can receive incoming funds prior to withdrawing revenues.
• Only one PayPal account can be associated with your Gigsido profile. This is a permanent association and cannot be changed.
• Revenues are only available for withdrawal after a 14 day safety clearance period.
• PayPal charges 2% of the total withdraw sum, and up to a maximum of $1 when withdrawing funds. Withdrawing $50 or more in a single withdraw will save you money.
• All withdraws are final and cannot be changed. Once a withdrawal has been started, nothing can be changed.

General Terms

• Any type of spamming will result in the member's account being permanently banned. This means both the account and IP address.
• Each member is only allowed one member account. Never register for more than one member account, doing so will get your accounts terminated.
• If there is a dispute with any other member always use the Gigsido contact us page to contact customer support. Never request PayPal or Alertpay to reverse payment or request a refund payment back to Gigsido. Doing so could get your account suspended, always contact Gigsido customer support with any disputes your unable to resolve mutually with other members.
• Sellers will be able to withdraw their revenues from blocked accounts after a safety period of 45 days, depending on block reason, from day of last cleared payment received in their account and subject to approval.
• Gigsido may make changes to its Terms of Service from time to time. When these changes are made, Gigsido will make a new copy of the Terms of Service available at http://www.gigsido.com/terms_of_service
• After any changes to the terms of the service, if you use Gigsido, it will be implied that you agree to the updated terms of services.

Disputes

• We encourage our buyers and sellers to resolve issues between themselves using the Gigsido internal messaging system. If for any reason this process fails, you can use the "Contact Us" page.
• If necessary, refunds will be deposited funds into your Gigsido account, not refunded PayPal or Alertpay accounts.

  Further Detailed Terms and conditions. Gigsido.com operates a membership marketplace service for members to contact each other online for purposes of buying and selling Gigs also known as services.

By using the Gigsido.com Website (the "Website") you agree to be bound by these Terms of Use (this "Agreement"), whether or not you register as a member ("Member") or are just visiting the site. If you wish to become a Member and communicate with other Members and make use of the Gigsido.com service (the "Service"), read these Terms of Use.  You indicate by becoming a member of the site your acceptance of them.

This Agreement sets out the legally binding terms of your use of the Website and your membership in the Service and may be modified by Gigsido.com from time to time, such modifications to be effective upon posting by Gigsido.com on the Website. This Agreement includes Gigsido.com’s Acceptable Use Policy for Content Posted on the Website, Gigsido.com Privacy Policy, and any notices regarding the Website.

We invite our members to enjoy all the features this site has to offer. However, we require that each member abide by the Terms and Conditions along with any amendments thereto that Gigsido.com establishes at their sole discretion and in accordance with their established procedures. Failure to abide by these rules will result in immediate termination of access to this site, without refund or recourse.

• The sharing of logon passwords and user-names is prohibited. Our system is designed to detect this immediately, and suspend any account where more than one person signs on using the same username and password.
• When making a posting you are solely responsible for it and agree that you have all rights of ownership to the content of the posting. No bulk e-mail, junk mail or spam, chain letters, or repeat postings of the same message is permitted anywhere on the site.
• Treat other members with courtesy and respect when posting messages to the messaging system. No unnecessary name calling or abuse toward any member is allowed.
• Do not use vulgarity, obscenity, profanity, ethnic slurs, hate speech, or sexually explicit language, to harass, abuse, or threaten other members. Do not libel or defame others. Such behavior will result in immediate termination of access to this site, without refund or recourse.
• Discretion. Gigsido.com reserves the right, in its sole discretion, to reject, refuse to post or remove any listing by you, or to deny, restrict, suspend, or terminate your access to all or any part of the Gigsido.com services at any time, for any or no reason whatsoever, with or without prior notice or explanation, and without liability. Gigsido.com expressly reserves the right to remove your profile and/or deny, restrict, suspend, or terminate your access to all or any part of the Gigsido.com services if Gigsido.com determines, in its sole discretion that you have violated this Agreement or pose a threat to Gigsido.com and/or its members.
• You are solely responsible for the Content that you post on or through any of the Gigsido.com Services, and any material or information that you transmit to other Members and for your interactions with other Users.

Responsibility & Disclaimer. You understand that all postings, messages, text, files, images, photos, video, sounds, or other materials ("Content") posted on, transmitted through, or linked from the Service, are the sole responsibility of the person from whom such Content originated. More specifically, you are entirely responsible for each individual item ("Item") of Content that you post or otherwise make available via the Service.

You understand that Gigsido.com does not control, and is not responsible for Content made available through the Service, and that by using the Service, you may be exposed to Content that is offensive, indecent, inaccurate, misleading, or otherwise objectionable.

Furthermore, the Gigsido.com site and Content available through the Service may contain links to other websites, which are completely independent of Gigsido.com. Gigsido.com makes no representation or warranty as to the accuracy, completeness or authenticity of the information contained in any such site or this site. Your linking to any other websites is at your own risk. You agree that you must evaluate, and bear all risks associated with the use of any Content taken from this site or some other third party website.

Gigsido.com is not liable for any Content or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed or otherwise made available via the Gigsido.com Service. You acknowledge that Gigsido.com has no duty to pre-screen or approve Content and that it is presented “as-is” with NO WARRANTY EXPRESSED OR IMPLIED by the user posting that Content.

Third Party Content, Sites, And Services

The Gigsido.com site and Content available through the Service may contain features and functionalities that may link you or provide you with access to third party content which is completely independent of Gigsido.com, including, but not limited to, web sites, directories, servers, networks, systems, information and databases, applications, software, programs, products or services, and the Internet as a whole.

Your interactions with organizations and/or individuals found on or through the Service, including payment and delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such organizations and/or individuals. You should make whatever investigation you feel necessary or appropriate before proceeding with any online or offline transaction with any of these third parties.

You agree that Gigsido.com shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings. If there is a dispute between participants on this site, or between users and any third party, you understand and agree that Gigsido.com is under no obligation to become involved. In the event that you have a dispute with one or more other users, you hereby release Gigsido.com, its officers, employees, agents and successors in rights from any and all claims, demands and damages (actual and consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes and / or our service. If you are a California resident, you waive California Civil Code Section 1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which, if known by him must have materially affected his settlement with the debtor."

Disclaimers.

Gigsido.com is not responsible for any incorrect or inaccurate content posted on the Website or in connection with the Service, whether caused by users of the Website, Members or by any of the equipment or programming associated with or utilized in the Service.

Gigsido.com is not responsible for the conduct, whether online or offline, of any user of the Website or Member of the Service.

Gigsido.com assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, user or Member communications.

Gigsido.com is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any Website or combination thereof, including injury or damage to users and/or Members or to any other person’s computer related to or resulting from participating or downloading materials in connection with the Web and/or in connection with the Service.

Under no circumstances will Gigsido.com be responsible for any loss or damage, including personal injury or death, resulting from anyone’s use of the Website or the Service, any Content posted on the Website or transmitted to Members, or any interactions between users of the Website, whether online or offline.

The Website and the Service are provided "AS-IS" and Gigsido.com expressly disclaims any expressed or implied warranty along with any warranty of fitness for a particular purpose or warranty of non-infringement.

Gigsido.com cannot guarantee and does not promise any specific results from use of the Website and/or the Service.

Limitation on Liability. EXCEPT IN JURISDICTIONS WHERE SUCH PROVISIONS ARE RESTRICTED, IN NO EVENT WILL Gigsido.com BE LIABLE TO YOU OR ANY THIRD PERSON FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING ALSO LOST PROFITS ARISING FROM YOUR USE OF THE WEB SITE OR THE SERVICE, EVEN IF Gigsido.com HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, Gigsido.com’s LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO Gigsido.com FOR THE SERVICE DURING THE TERM OF MEMBERSHIP.

Indemnity. You agree to indemnify and hold Gigsido.com, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above.
